CATERPILLAR VIRTUAL EVENT ATTENDEE

AGREEMENT TO TERMS AND CONDITIONS

 

PLEASE READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY.  THEY REPRESENT A BINDING LEGAL AGREEMENT BETWEEN YOU AND CATERPILLAR.

 

In consideration of being granted access to attend a virtual or online event (the “Event”), as facilitated or offered by Caterpillar (as defined below), the person submitting this registration (herein referred to as “I” or “me”), acknowledges, agrees with and consents to the following terms and conditions:

 

MEDIA CONSENT, RELEASE AND WAVIER:

 

I authorize Caterpillar Inc., its subsidiaries, designees, licensees, and affiliates (collectively “Caterpillar”), without restriction, the right to record my name, likeness, image, voice and picture (hereafter my “Personal”) on film, videotape, or any other physical or digital media (hereafter the “Media”) while participating in the Event (such Media containing or reflecting my Personal referred to herein as the “Materials”).

I consent to and agree that Caterpillar may use the Materials in whole or in part and with or without my name, in any print, audio, video, digital, or electronic format, for any lawful advertising, promotional or publicity purpose including, but not limited to, brochures, banners, advertising, presentations, displays, trade publications and trade show exhibits, website content, and to Caterpillar’s distribution of the Materials internally and to third parties, in perpetuity, worldwide (the “Purpose”).  I agree that the Materials may be edited and otherwise altered at the sole discretion of Caterpillar, and that any testimonials or statements I make may be revised or changed by Caterpillar so long as the meaning is not materially altered.

I release Caterpillar from and waive any expectation of confidentiality or privacy right and acknowledge that attendance and participation in the Event is voluntary.  I will not receive financial or other compensation, and forever waive all past, present and future compensation rights, publicity rights, or other interests that I may have in or relating to the Materials.

 

I understand I may revoke this consent at any time by notifying the contact listed immediately below. I acknowledge that while I may withdraw my consent at any time, the withdrawal of my consent will not affect the use of Materials prior to my withdrawal and that I cannot demand the destruction or re-collection of already printed or distributed materials incorporating or using my Personal.

FOR THE PURPOSES OF THE EU GENERAL DATA PROTECTION REGULATION – EU REGULATION 2016/679 (hereafter the “GDPR”):

 

• Caterpillar Centro de Formación SL is the controller with respect to the personal data collected about me, namely my Personal collected for the Purpose as described above.
• I agree that the Materials may be created and/or used in any media now known or ever developed (including without limitation video and audio recordings that may appear on radio, television, online broadcasts and forums, social media communities, and other media). The Personal will be processed for the specific Purpose for which it was collected on the basis that Caterpillar has obtained my prior explicit consent.

Caterpillar’s Global Privacy Statement describes how Caterpillar collects, processes and shares personal data and rights that a person may have under privacy laws, and other information relevant to Caterpillar’s processing of personal information. Caterpillar’s Global Privacy Statement is available at http://www.caterpillar.com/dataprivacy. For more information about how Caterpillar processes personal data, including more details on invoking rights under the GDPR, please contact the above listed individual. 

I HAVE READ AND VOLUNTARILY ACCEPT THIS RELEASE, and further state that no oral representations, statements or inducements apart from this Agreement have been made. I acknowledge that I am assuming all risks of injury to myself or damage, up to and including death. I have considered that if this Release was not as broad as it is, the terms and obligations governing my, attendance, observation, participation, and/or performance during the Event would be considerably different, and I waive the right to bargain for different waiver. I hereby acknowledge that I fully understand its terms and the consequences and effects of its terms and of my acceptance of this document.

 

 

CHOICE OF LAW:

 

These terms and conditions shall be governed by and construed in accordance with the laws of Switzerland, without giving effect to its conflict of law rules.
